2. Services Provided

  • Scam Recovery Services: We provide assistance in recovering funds lost due to online scams, fraud, phishing, or other fraudulent activities.
  • Refund Assistance: We support clients in initiating refund claims for defective products, undelivered services, or other legitimate refund requests.
  • Banking Services: We offer banking consultations and payment processing solutions related to chargeback and scam recovery services.

3. User Eligibility

By using our website and services, you represent and warrant that:

  • You are at least 18 years old.
  • You are legally capable of entering into a binding contract.
  • You have provided accurate, complete, and up-to-date information when requesting services.

If you do not meet these eligibility requirements, you are prohibited from using our website or services.


4. Fees for Services

Our services are offered for a fee. The fee structure is as follows:


A. Chargeback Assistance Fees

  • Standard Chargeback Fee: We charge a fee for each chargeback request processed. The fee is assessed once you initiate a chargeback request with our assistance.
  • Complex Chargeback Cases: For more complex chargeback cases, such as those involving multiple merchants or lengthy investigations, we may charge an additional fee. This will be communicated to you upfront before proceeding.

B. Scam Recovery Service Fees

  • Standard Scam Recovery Fee: Our fee for scam recovery services will be in percentages depending on the  total amount recovered. The fee is applied only if we successfully recover funds for you. If no funds are recovered, you will not be charged for the recovery service.
  • Consultation Fee: For an initial consultation regarding scam recovery, we may charge a fixed fee. This fee maybe refundable or non-refundable, even if you decide not to proceed with the scam recovery process.

C. Refund Assistance Fees

  • Standard Refund Assistance Fee: We charge a fee for the total refund amount for each refund request processed. This fee is assessed when we initiate a refund claim on your behalf and is payable upon service initiation.
  • Complex Refund Cases: In certain cases where the refund process requires more extensive intervention, we may charge an additional fee. You will be notified of these fees in advance.

D. Banking Services Fees

  • Consultation Fees: For banking-related consultations, we charge a fixed fee per session.
  • Payment Processing Fees: For payment processing services, a fee may apply, depending on the service required.

E. Payment Terms

  • Payment for Services: Payment is due in full at the time you request a service. We accept payments via PayPal, Bank Transfer, Zelle and more, including but not limited to credit/debit cards, bank transfers, and other online payment methods.
  • Refund Policy: Fees are generally non-refundable once services have commenced. However, if we are unable to provide the service as agreed, we may issue a partial or full refund at our discretion, depending on the circumstances.
  • No Guarantee of Success: While we make every effort to assist with chargebacks, scam recovery, and refunds, we do not guarantee successful outcomes. If we are unable to recover your funds, no further fees will be charged beyond the initial consultation and service initiation fees.

By using our services, you agree that we may collect, use, and store your personal and financial information in accordance with our Privacy Policy. Your information will be used solely to provide services, facilitate transactions, communicate with you, and comply with legal requirements.


6. User Responsibilities

You agree to the following responsibilities when using our services:

  • Accuracy of Information: You must provide accurate, complete, and truthful information when requesting chargeback assistance, scam recovery, or refund services. Any false or misleading information may result in the denial of services and possible legal action.
  • Cooperation: You must fully cooperate with us throughout the process, including providing any required documentation or information in a timely manner.
  • Compliance with Laws: You must comply with all applicable laws and regulations, including those related to fraud, banking, and data protection, when using our services.

7. Limitation of Liability

SmartPro Funds will not be liable for any damages arising from:

  • The failure to recover funds through chargebacks, scam recovery, or refund requests.
  • Delays in processing services.
  • Any issues arising from third-party institutions, such as financial institutions or merchants, including but not limited to delays, refusals, or adverse decisions on chargeback or scam recovery requests.
  • Any loss of data, transactions, or financial loss due to fraud, technical errors, or other circumstances beyond our control.

Our liability is limited to the amount paid for the specific service rendered, and we are not responsible for any indirect, incidental, or consequential damages arising from the use of our services.


8. Dispute Resolution

In the event of a dispute regarding these Terms of Use, you agree to resolve the dispute through binding arbitration under the rules of Arbitration Association. The arbitration will take place  and the laws will govern this Agreement.


9. Termination of Service

SmartPro Funds reserves the right to suspend or terminate your access to our services at any time for any reason, including but not limited to:

  • Violation of these Terms of Use.
  • Provision of false or misleading information.
  • Illegal or fraudulent activities.
  • Failure to pay fees when due.

If your account or service access is terminated, you will remain responsible for any fees owed for services rendered up to the date of termination.
